Welcome to SAM. We are committed to protecting your privacy. This policy defines our privacy regulations, personal data which we collect, how we use and share, along with your choices and rights with respect to this information. This Privacy policy applies to our services everywhere. Also, we will comply with all local laws related to the applications described in this policy. If there is any inconsistency between this policy and local law, we will comply with local laws. SAM is produced and regulated by entities identified in the Terms of Use applicable to your country of residence (“I”, “We”, “Agent”, “employees” and “directors”). This policy applies to all users of SAM, including those of our website users https://samlaos.com/ (“Website”), any SAM mobile application (“App”) and any services we provide through the Website or App. The same applies when you contact us via telephone, email, correspondence, social media, in person, or other means of contact (collectively, the "Services"). This policy applies to our users and partners. In this Policy, individuals who use our Services are referred to as “Users.”, “Passenger”, “You”, and the person who provides transportation services to passengers are referred to as “Partners”, “Drivers”. By accepting these Terms of Use, you agree that we will handle your data in the manner described in this policy.

      As for “we” or “SAM”, we mean SAM and the subsidiaries, affiliates, affiliates and companies under the same control located headquartered in Laos (company registration number 01-00027057), current address: 077 Moo 07 Road, Samsenthai Road, Sisattanak District, Vientiane Province, Lao People's Democratic Republic. In order to use the service from the SAM app, you have to agree to the terms and the conditions we are about to mention as follows:

1.    USAGE OF SAM APP

1.1     "SAM Application "   is an information preparation area, social services, passenger assistance, driver communication, submitting a transportation service request between each other. SAM is not a transportation service provider. Transportation Services are provided by drivers under a contract (with you). For transportation, drivers are independent transportation providers (personal or corporate) as professionals in transportation services. SAM is not in any way responsible for arising out of the performance of the contract which was made between the passenger (you) and the driver. The disputes arising from the rights of the user legal obligation or the laws relating to the provision of transportation services will be amended between the user and the driver. The information about the user and the transportation service will be saved to the SAM App and will be sent to the third party service provider through the SAM App that the passenger has set up in the profile on the app.
1.2     The passenger (you) enters into a contract with the driver for transportation services via the SAM App. The payment process depends on the options supported by the App in the area where you are served. You can choose to pay for your service via cash or SAM in-app payment. The SAM in-app payment is handled through a separate agreement for the trip. Fees do not include applicable taxes as required by law. This cost may include fees, tolls, airport fees or fees for split payments. You also have the added option to tip the driver directly or through SAM in-app payments. We may set a maximum amount of tip value that can be paid at our sole discretion.
1.3     During installation of the SAM Application, the passenger's phone number will be sorted in our database. If you stop using your phone number, you must inform us within 7 days that we will anonymize your information. In order to prevent if a new user of your old number signs up for SAM, the app will access your personal data. If you do not notify us of the change of information.

2.   Discounts and promotions

2.1     SAM may send promotional discounts, advertising promotion or code number which can be used as a discount to reduce transportation charges in the payment process after completing the service or use for returns in other ways related to the provision of services or rewards from partner companies. Advertising promotion code expiration information will be displayed within the app once you have applied the code to your account.
2.2     Promotional code once applied, cannot be used as a discount on the service fee for the next service payment cycle and the code will no longer be available. Only one discount code can be used per trip.
2.3     SAM reserves the right to cancel any promotional code at any time for any reason, including in the event that SAM finds that the code has been used in an illegal or fraudulent way, including codes issued by mistake, and expired code.

3.   SAM in-App payment

3.1     The payment options are based on the options supported by us. You can pay for transportation by credit & debit card, mobile banking or other forms of payment that we support on the app. In providing the SAM in-App payment service, we act as a commercial agent in concluding charges contracts between drivers and passengers, as well as the authority to accept payments from passengers and forward the payment to the driver. Your obligation to the carrier is fulfilled upon receipt of a payment instruction to transfer funds to SAM's bank account. You, as the passenger, are responsible for ensuring that payment is made. and make sure there is enough money.
3.2     You may choose to tip your driver by using in-app payment service. Tips can be paid via SAM in-app payment by any means permitted by SAM for that purpose. SAM will not collect commissions for tip commissions and the tip will be transferred to the driver in full without any taxes. We reserve the right to withhold tips. If such conduct is suspected to be fraudulent, illegal, for purposes other than tipping in connection with the services provided or used in conflict with the terms of conditions.
3.3     After making a payment with SAM in-App Payment, SAM receives your payment and forwards it to the driver. SAM may ask you more information for verifying your payment.
3.4     When making a payment with SAM in-App Payment for transportation services, SAM is not responsible for third party charges such as (bank fee) these service providers may impose additional fees when processing payments related to SAM in-App Payment. We are not responsible for such additional fees and hereby disclaims all responsibility in this matter. Your payment method may be listed under the terms and additional terms imposed by the relevant third-party payment provider. Please read the terms before using your payment method.
3.5     Sam is responsible for the functionality of SAM in-App Payments and provides support in resolving disputes related to SAM in-App Payment. For payment service support contact via [email protected]. The inquiries sent by email or SAM will be responded to within 7 working days and complaints will be resolved. The applications related to SAM in-App Payment within 15 working days.
3.6     Advance Fare You will be offered different fares depending on the type of transportation service. Which you accept a fare set by SAM, with a prepaid fare notified to you through the SAM app before requesting a ride. The journey takes longer than expected due to traffic or other factors, or when circumstances occur or unexpected impact on the nature of the trip (such as tolls).

4.   Booking and Cancellation of Transportation Services

4.1     If you book transportation services and the driver has agreed to accept your request, the transportation service will be considered ordered and must proceed to be completed.
4.2     When the driver has confirmed that the driver will make the delivery service go well and you will make a separate agreement with the driver in order to arrange travel according to your agreement with the driver with whom you have agreed, SAM is not the transportation provider and it is not related to your contract with the relevant driver.
4.3     Cancellation of transportation service orders will be considered as an incident where the driver has responded to your request for delivery service but later rejected or canceled by you. You will be charged a cancellation fee.
4.4     If you cancel multiple transportation requests within 24 hours in a row, we may temporarily suspend your account as a warning of inappropriate behavior. After several such notifications, we may suspend your account for a longer term (e.g. 6 months), after which time you may inquire in order to request to open your account again and your request will be reviewed by SAM.
4.5     When the driver has successfully notified the passenger about the service and passengers or those who have been ordered to transport do not arrive at the vehicle within the specified period. The request will be canceled. Sometimes the driver may decide to cancel your request. Please note that we are not responsible for such circumstances.
4.6     When the driver has arrived at the pick up point and sends a notification message mentioning that the driver has arrived at the pick-up point, SAM may begin to charge you for additional time-wasting at the rates we set out in the SAM App.

5.   Right to use Sam App

5.1     As long as you are within the terms and general conditions which we agree to grant to you a royalty-free revocable license and non-exclusive rights to access and use the app as the general terms and conditions, privacy, and terms applicable by App-store and Google-play. In case that your right to use the SAM App is terminated, such non-exclusive license will also be terminated.

6.   Liabilities

6.1     As mentioned before, Sam App is an app that provides social communication services between passengers and drivers. SAM is not a transportation agent. Therefore, we will not guarantee and are not responsible for the quality of the delivery service of the driver as the use of SAM. The ride-hailing app depends on driver behavior. SAM does not guarantee that you will always receive responses to ride calls.
6.2     SAM app does not provide transportation services to passengers and is not an agent providing transportation services to other transportation companies. SAM app is used for the purpose of organizing transportation service records.
6.3     We do not have the section on a user's right to request a refund on a fundamental basis. Claiming refunded by the transportation service will not withdraw you from the agreement during the use of the transportation service.
6.4     SAM service is provided as conditions and as available on the application. It does not represent a guarantee that access to the SAM app will be uninterrupted or error-free. In the event of a software error, we will resolve those issues as soon as possible. However, please be aware that some functions of the app may be suspended due to technical issues and we cannot guarantee that the app will run all the time. For example, during times of emergency where the service may be interrupted.
6.5     SAM along with its custodians, agents and employees shall not be liable for any loss or damage that may occur to you from your usage of the SAM App.
6.5.1     Damages, financial losses or caused directly or indirectly
6.5.2     Loss of Profit
6.5.3     Loss of returns
6.5.4     Losses from data inaccuracy
6.5.5     and other types of damage
6.6     You agree to fully indemnify and SAM's affiliates, agents, employees and directors harmless from any claims or losses. (including liabilities, damages, costs and expenses of any kind) that they incur from your use of the app.
6.7     SAM may terminate your account immediately if you violate the terms. These general conditions are deemed necessary to protect SAM's integrity or the safety of the driver.

7.   Guidelines for using Sam

7.1     As SAM is not a provider of transportation service brokers, any issues related to the defect or quality of transportation services will be fixed according to the rules and regulations of carriers or related government agencies.
7.2     We ask you to fill out a feedback form in the SAM app. This allows us to offer suggestions to drivers available through the SAM app, improving the quality of their service.
7.3     We expect you to use the SAM app honestly and to respect the drivers provided through the SAM app. We reserve the right to close your account if you violate the terms set forth in the terms and these general conditions. In these cases, your SAM app account will be suspended and revoked without prior notice.
7.4     SAM will make every effort to ensure that the driver is honest and respectful for their profession and passengers use the SAM app. However, we are not in a position to guarantee that the service provider of the transportation service provided on the SAM app will be satisfactory and comply with the above-mentioned criteria at all times If you encounter unsuitable transportation services, please notify the company responsible for the service regulator or our customer support.

8.   Amendments to terms and general conditions

8.1     If the terms and general conditions in essence are amended, you will be notified via email or notifications via SAM app. If you continue to use the SAM app, you agree to the modifications.

9.   Final provision

9.1     The general terms and conditions shall be construed and enforced in accordance with the laws of Lao People's Democratic Republic. Related Disputes arising from general terms or agreements that cannot be settled by negotiations shall be resolved in the courts of the Lao People's Democratic Republic.
